Italian Citizenship After the 2025 Reform: Is the Door Really Closed?

Advanced legal strategy

By Coco Ruggeri - May 6, 2026

The recent reform introduced by Law No. 74/2025 has significantly reshaped the legal landscape of Italian citizenship by descent (jure sanguinis), particularly through the introduction of strict generational limits.

At the same time, several constitutional challenges have been brought before the Italian Constitutional Court. While these proceedings are still ongoing, early indications suggest that the Court may ultimately confirm the government’s position, thereby consolidating the new restrictive framework.

For many families, especially those with more distant Italian ancestry, this has created uncertainty and, in some cases, the perception that their path to recognition has come to an end.

However, this conclusion may be premature.

Beyond Generational Limits: A Strategic Legal Approach

At Coco Ruggeri Law, we have long approached citizenship law not as a static field, but as an area requiring continuous legal interpretation and strategic development.

In light of the recent reform, Attorney Adriana Coco Ruggeri has developed an advanced legal strategy aimed at overcoming the generational limits introduced by the new law, including in cases that would appear, under a strictly literal reading, to fall outside the permissible scope.

This strategy is not theoretical.

It is the result of:

  • extensive litigation experience in citizenship matters
  • in-depth constitutional analysis
  • and independent intellectual development focused on identifying structural inconsistencies within the current legal framework

Importantly, this strategy is particularly well-grounded in so-called “1948 cases” that exceed the newly introduced generational limits, as well as in situations involving female Italian ancestors who were naturalized.

This creates a distinct and robust legal pathway, separate from the issues directly addressed by the recent legislative reform.

A Method Proven at the Highest Level

This same methodological approach has already led to significant recognition before the Italian Supreme Court (Corte di Cassazione).

In a recent case concerning the so-called “minor issue,” the legal arguments developed by Attorney Ruggeri were met with such strength and clarity that the opposing party formally requested that the Court accept our claims and legal reasoning, an outcome that remains highly unusual and speaks directly to the solidity of the underlying legal construction.

This is not simply experience.
It is advanced legal work grounded in results.

On the Circulation of Legal Strategies

In a rapidly evolving legal environment, it is not uncommon for innovative legal arguments to begin circulating within the professional community.

Portions of the strategy developed by Attorney Ruggeri have, in part, been shared and discussed among colleagues. However, what is currently being applied in the market often reflects only partial or simplified versions of a much more complex legal framework.

This distinction is critical.

When such arguments are used without a full understanding of their structure and underlying legal rationale, they may present significant vulnerabilities and, in certain cases, could ultimately lead to unfavorable outcomes.

The effectiveness of this strategy lies in its complete and internally coherent formulation, developed through independent legal research and direct litigation experience.

A Strategy Still Being Refined

It is important to emphasize that this legal strategy is currently being carefully evaluated and refined in light of the upcoming Constitutional Court decisions expected in the coming months.

This approach ensures that:

  • the strategy remains fully aligned with the evolving legal framework.
  • any potential judicial confirmations are properly integrated.
  • and each case is pursued with the highest level of precision and effectiveness.

Moving Forward with Clarity

If the Constitutional Court ultimately confirms the current law, the legal landscape will not disappear, it will simply become more technically demanding.

In this context, the difference between success and failure will increasingly depend on:

  • the depth of legal reasoning.
  • the quality of the strategy applied.
  • and the ability to move beyond standard interpretations.

At Coco Ruggeri Law, we do not simply follow developments.
We work to anticipate and navigate them.

A Final Consideration

If you have been told that your case is no longer viable due to generational limits, or that a standard “1948 strategy” is the  available path, it may be worth seeking a second opinion.

Because in law, the outcome is not determined only by what the law says - but by how it is interpreted, structured, and strategically argued.
